Content Policy

Artly is a general-purpose AI image and video generation platform. Everything created here is meant to be safe for work. This Content Policy sets out what is and is not permitted. Violations result in account termination and, where required by law, reporting to the relevant authorities.

1. Absolute Prohibitions — Zero Tolerance

The following are strictly prohibited on Artly with no exceptions. Violations result in immediate and permanent account termination, preservation of relevant evidence, and reporting to competent authorities where required by applicable law.

CSAM — Child Sexual Abuse Material

It is absolutely prohibited to generate, upload, store, distribute, or attempt to generate any sexual content depicting minors (persons under 18 years of age), whether real, drawn, AI-generated, or otherwise. This includes content in which any person is depicted as a minor in a sexual context.

Artly complies with the PROTECT Our Children Act (18 U.S.C. § 2258A) and the TAKE IT DOWN Act (Public Law 119-12, 2025). Upon detecting or receiving a report of suspected CSAM, we may immediately restrict access to or remove the content, suspend or permanently terminate the relevant account, and preserve necessary records as permitted or required by law. Where required by applicable law, we will report the matter to the National Center for Missing & Exploited Children (NCMEC) or other competent authorities and cooperate with valid law-enforcement requests.

NCII — Non-Consensual Intimate Imagery of Real Persons

It is absolutely prohibited to generate, upload, or distribute non-consensual intimate imagery (NCII) — meaning sexual or intimate images of real, identifiable individuals created or distributed without their explicit consent. This includes:

  • AI-generated deepfakes, face-swaps, or nudification of real, identifiable individuals.
  • Uploading authentic intimate images of a real person without that person’s verified consent.
  • Synthetic imagery designed to appear as real persons in intimate contexts.

We comply with the TAKE IT DOWN Act, which requires platforms to remove NCII within 48 hours of a verified request. We also honor requests submitted through the StopNCII.org hash-matching program.

To submit an NCII removal request: hello@makeartly.com with the subject line “NCII Removal Request”. We respond within 24 hours and remove confirmed NCII within 48 hours.

2. No Sexual or Adult Content

Artly is a safe-for-work service. Sexually explicit content, nudity, and material produced primarily for sexual gratification are not permitted — whether the subject is real, fictional, stylised, or wholly synthetic. This is a property of the product, not a preference: there is no paid tier, region, or account type on which such content is allowed.

Prompts are screened before generation, and requests for prohibited content are refused rather than fulfilled. Attempting to work around these controls — through euphemism, encoding, prompt injection, or repeated rephrasing — is itself a violation of this policy.

Artistic, educational, medical, and documentary nudity are not exceptions here. If your work requires that material, Artly is not the right tool for it.

3. Age Requirement

You must be at least 13 years old to use Artly. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian, who accepts our Terms of Service on your behalf. Some jurisdictions set a higher minimum age for consenting to the processing of personal data; where they do, the higher age applies.

We do not knowingly collect personal information from children below the applicable minimum age. If you believe a child has provided us with personal information, contact hello@makeartly.com and we will delete it.

4. Prohibited Content Categories

In addition to the prohibitions above, the following content is not permitted:

  • Real people without consent: Generating a real, named, or clearly identifiable person — public figure or private individual — in a way that could be mistaken for a genuine photograph or recording, or that places them in a situation they did not agree to.
  • Deceptive media: Content presented as an authentic photograph, recording, document, or news event when it is not; fabricated evidence; synthetic audio or video of a real person appearing to say or do something they did not.
  • Violence and gore: Graphic depictions of real-world violence, torture, or death, and content that glorifies self-harm, suicide, or disordered eating.
  • Hate content: Content promoting violence, discrimination, or hatred based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Terrorism and incitement: Content promoting, glorifying, or facilitating terrorism, mass violence, or acts of war against civilian populations.
  • Illegal goods and dangerous instruction: Content facilitating the sale of controlled substances, weapons, or stolen goods, or giving operational instructions for weapons or attacks.
  • Doxing and personal information: Revealing or requesting personally identifiable information about real individuals without their consent.
  • Malware and exploits: Using the Service to generate, host, or distribute malicious code, phishing content, or cyberattack tools.
  • Intellectual property violation: Reproducing copyrighted works, or using trademarks in ways you are not authorised to.

5. What You May Create

Within the limits above, Artly is built for ordinary creative and commercial work: illustration and concept art, portraits and headshots of yourself or of consenting subjects, product and marketing imagery, design mockups, character and world design, short video from a prompt or a still image, and edits of images you own.

People shown in generated results are synthetic unless you supplied a reference image. Any resemblance to a real person in a purely prompt-generated result is unintended.

6. Uploads Are Your Responsibility

If you upload an image as a generation input — a reference photo, a style reference, a frame to animate — you represent and warrant that:

  • You own the image, or have explicit authorisation to use it for AI generation.
  • If the image shows an identifiable real person, you have that person’s informed consent to use their likeness this way.
  • The subject of any uploaded image is 18 years of age or older.
  • The upload does not violate any applicable law, intellectual property right, or privacy right.

We may scan uploaded images for CSAM using hash-matching and other detection technologies. Accounts that upload prohibited content are permanently banned.

7. Moderation & Enforcement

  • Prompt screening: Prompts are checked before generation and refused if they request prohibited content.
  • Output filtering: Generation runs with the strictest safety setting our model providers offer, and results that trip those filters are not returned.
  • Human review: Flagged content goes to human moderator review within 24 hours.
  • Strikes: A first violation results in content removal and a warning. A second results in a 30-day suspension. A third results in a permanent ban.
  • Zero-tolerance exceptions: CSAM and NCII result in an immediate permanent ban with no warning, regardless of prior history.
  • Appeals: Account actions (except mandatory legal takedowns) may be appealed within 14 days by contacting hello@makeartly.com.

8. Reporting Abuse

If you encounter content that violates this policy, please report it. We investigate reports within 24 hours. Use our content report & takedown form, or contact us through the channels below.

9. DMCA / Copyright

We respond to valid DMCA takedown notices. Send notices to hello@makeartly.com including: identification of the copyrighted work, identification of the infringing material and its location on our platform, your contact information, a statement of good faith belief, and your signature (physical or electronic).

10. Policy Updates

We review and update this Content Policy as laws and platform capabilities evolve. Material changes will be communicated by email and in-app notification at least 14 days before taking effect.
