Content Policy

2. Age Verification Requirement

The Service is available only to users who are at least 18. Parental or guardian consent is not a substitute. Users who are 18 or older may use the Service only in accordance with this policy, our Terms of Service, and all applicable safety and usage limits. Users must truthfully confirm their age, and we may require age assurance or re-verification where required by law or reasonably necessary for safety. We may restrict or suspend access while investigating a reasonable concern that a user is under 18.

We implement prompt/inference-level blocks to prevent the generation of content depicting or implying the involvement of minors. Attempts to bypass these controls via jailbreaking, prompt injection, or other methods are prohibited.

3. Prohibited Content Categories

In addition to the absolute prohibitions in Section 1, the following content is prohibited:

• Real person deepfakes without consent: Any AI-generated sexual content depicting a real, named, or clearly identifiable person without documented consent. This includes public figures, celebrities, and private individuals.
• Non-fictional violence or gore: Graphic depictions of real-world violence, torture, gore, or snuff content.
• Hate content: Content promoting violence, discrimination, or hatred based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics.
• Terrorism & incitement: Content promoting, glorifying, or facilitating terrorism, mass violence, or acts of war against civilian populations.
• Doxing & personal information: Revealing or requesting personally identifiable information of real individuals without consent.
• Malware & exploits: Using the Service to generate, host, or distribute malicious code, phishing content, or cyberattack tools.
• Intellectual property violation: Generating content that reproduces copyrighted works or uses trademarks in unauthorized ways.

4. Permitted Adult Content

Makeartly is an adult platform and permits the generation of consenting adult sexual content, subject to the restrictions in this policy and our Terms of Service. Permitted content includes:

• Fictional AI-generated adult imagery featuring clearly adult (18+) subjects.
• Fantasy, artistic, or stylized adult content not depicting real identifiable persons.
• Erotic fiction and narrative content not targeting or depicting real individuals without consent.

All generated personas are entirely synthetic. Any resemblance to real persons is unintentional. Content depicting real people requires documented consent filed with hello@makeartly.com before publication.

5. User Upload Responsibility

If you upload images to the platform as generation inputs ("face swap" reference photos, style references, etc.), you represent and warrant that:

• You own or have explicit authorization to use the uploaded image for AI generation.
• If the image depicts an identifiable real person, you have that person's documented, explicit, and informed consent for use in adult AI generation.
• The subject of any uploaded image is 18 years of age or older.
• The upload does not violate any applicable law, intellectual property right, or privacy right.

We scan uploaded images for known CSAM using PhotoDNA hash-matching and use other automated and manual safety tools to assess uploads, prompts, outputs, accounts, and usage patterns for prohibited content or attempts to evade controls. We may block or remove content, preserve relevant records, restrict or terminate accounts, and report matters where required by applicable law.

6. Content Moderation & Enforcement

• Automated filtering: Every prompt and uploaded image passes through automated safety classifiers before generation to identify and block prohibited requests.
• Human review: Content or activity flagged for manual review is reviewed by a human moderator within 24 hours.
• Proportionate action: Depending on severity, history, confidence, and risk, we may warn a user, request verification, block or remove content, limit rate or concurrency, cancel pending jobs, revoke sessions, restrict features, suspend, or terminate an account.
• Immediate action: We may act without prior notice where reasonably necessary for child safety, NCII, suspected illegality or fraud, an urgent safety or security risk, or continued attempts to evade controls.
• Records and reporting: We may preserve relevant information for investigation, enforcement, disputes, safety, or legal compliance and will make reports where required by law.
• Appeals: A material account action may be appealed within 14 days by contacting hello@makeartly.com. Include the account email and relevant request or transaction details. An appeal does not automatically pause an action, and content subject to a mandatory legal restriction will remain unavailable during review.

7. Reporting Abuse

If you encounter content that violates this policy, please report it immediately. We take all reports seriously and review them as promptly as reasonably possible, with priority given to reports involving child safety, imminent harm, or non-consensual intimate imagery. 8. DMCA / Copyright

We respond to valid DMCA takedown notices. Send notices to hello@makeartly.com including: identification of the copyrighted work, identification of the infringing material and its location on our platform, your contact information, a statement of good faith belief, and your signature (physical or electronic).

9. Policy Updates

We review and update this Content Policy regularly as laws and platform capabilities evolve. Material changes will be communicated via email and in-app notification at least 14 days before taking effect.
